This Policy governs the use of Artificial Intelligence ("AI") tools by ilerts.ai in the preparation, filing, and management of domain name dispute proceedings under the Uniform Domain-Name Dispute-Resolution Policy ("UDRP") and applicable country-code Top-Level Domain ("ccTLD") dispute resolution policies. It applies to all staff, contractors, and affiliated counsel acting on behalf of a Complainant or Respondent in such proceedings.
This Policy does not override any mandatory law, regulation, or specific dispute resolution provider rule (e.g., WIPO Supplemental Rules, national ccTLD registry policies). Where a conflict arises, the applicable provider rules or mandatory law prevail.
ilerts.ai adopts the following principles, reflecting the consensus position across the SCC AI Guide, VIAC Note on AI, AAA-ICDR Guidance, CIArb Guideline, and AAAi Standards:
AI Tools may assist with research, drafting, and analysis, but no AI Tool shall be permitted to make or substitute for a substantive legal judgment, including assessment of bad-faith registration/use, rights or legitimate interests, confusing similarity, or case strategy. All such determinations remain the responsibility of a qualified attorney.
Every AI-generated or AI-assisted output (legal research, citations, factual summaries, precedent analysis, evidence characterization) must be independently verified against primary sources (WIPO UDRP decisions database, applicable ccTLD precedent, registrar/WHOIS records, trademark registries) before inclusion in any Filing.
Use of an AI Tool does not diminish ilerts.ai's or its personnel's professional responsibility and accountability for any Filing. The attorney of record remains fully responsible for accuracy, completeness, and compliance, regardless of AI involvement in drafting.
Client data, case specifics, trademark portfolios, domain WHOIS details, and privileged strategy shall not be input into any AI Tool that does not provide contractual and technical guarantees of data confidentiality, non-retention for model training, and access control. Where feasible, data should be anonymized or redacted before use in third-party AI Tools.
Given the well-documented risk of AI "hallucination" (fabricated case citations, misstated precedent), ilerts.ai requires a mandatory citation-verification step for any AI-assisted legal research before it is relied upon in a Filing.
Where a Panel, provider, or opposing party requests information about the use of AI in preparing a Filing, or where applicable provider rules require disclosure, ilerts.ai will disclose the AI Tool(s) used and the nature of their use (e.g., research support, translation, drafting assistance) in good faith.
AI Tools will be used in a manner consistent with the integrity of the UDRP/ccTLD process and will not be used to generate misleading, fabricated, or manipulated evidence, nor to craft submissions designed to exploit Panel or algorithmic bias.
Subject to Sections 3 and 5, AI Tools may be used for:
AI Tools shall not be used to:
Clients will be informed, at engagement, that ilerts.ai may use AI Tools to support (not replace) legal work on their matter, consistent with Section 3. Any client objection to AI-assisted preparation of their specific Filing will be accommodated upon request.
Before any Filing is submitted:
Personnel using AI Tools in case preparation must complete internal training on: (a) the capabilities and limitations of approved AI Tools; (b) hallucination and bias risks; (c) confidentiality handling requirements; (d) this Policy. Competence with AI Tools is reviewed periodically as tools and provider practices evolve.
Only AI Tools that have been vetted and approved by ilerts.ai's designated compliance lead, based on data security, confidentiality guarantees, and reliability, may be used on client matters. An approved-tools list will be maintained and updated as needed.
This Policy will be reviewed at least annually, or sooner in response to material changes in UDRP/ccTLD provider rules, applicable law (including relevant AI regulation), or AI technology. This version supersedes all prior versions.
